Acceptance of conditions

The customer acknowledges having read, at the time of placing the order, the conditions stated on the site www.surfshop.ch and expressly declares to accept them without reservation. The present conditions of use govern the contractual relations between Surfshop 1028 Sàrl (VAT No. CHE-274.437.454) and its customer, both parties accepting them without reserve.

Order

A firm order without the possibility of cancellation is placed when the customer presses the "Confirm your order" button on the confirmation page. By placing an order, you are making an offer to purchase the products you have selected on our site. Surfshop 1028 Sàrl confirms the acceptance of the order and its progress to the customer at the email address provided during registration. Surfshop 1028 Sàrl reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order.

In case of error in the delivery details of the recipient, Surfshop 1028 Sàrl cannot be held responsible for the impossibility in which it could be to deliver the product. In case of delivery problem coming from the manufacturer (availability), Surfshop 1028 Sàrl will try to find an alternative solution in agreement with the customer.

By placing an order, you certify to be 18 years old or more.

Products

The photographs illustrating the products do not enter the contractual field. If errors are introduced there, in no case the responsibility of Surfshop 1028 Sàrl could be committed. Technical information and links are given for information purposes only. The technical specifications and/or the content of the delivered products may differ from the data provided by the manufacturer or displayed on his website, normal production tolerances are applicable and a difference between the registered data and the received product may occur. Depending on the settings, the colour display may differ from one screen to another. We cannot guarantee that the colours in the illustrations correspond exactly to those of the actual products.

Prices

The prices of the products are in Swiss francs (CHF), including Swiss VAT, but excluding packaging and shipping costs. Surfshop 1028 Sàrl reserves the right to change prices at any time. The prices indicated on the order confirmation are binding, even in case of variation between the date of order and the date of delivery of the goods. In case of price error on a product, Surfshop 1028 Sàrl reserves the right to modify this price by offering the customer the choice to cancel his order if the new price does not suit him.

Product availability:

We do our best to regularly update the availability of our products. Nevertheless, it is possible that some items may not be in stock at the time of your order. If this should happen, you will be notified by e-mail and a solution will be proposed (see "delivery time").

Pre-order items

The availability date is displayed on the product sheet on the website.

Pre-ordering gives you the possibility to buy and therefore reserve your product in advance. You are sure to have it as soon as it is available on the site.

Please note that the manufacturer may change the availability date at any time. Please note that all products ordered with your pre-order item will also be delivered on this date, unless you advise us otherwise.

Payment methods

The simple and totally secure solution for paying for your purchases with a Eurocard/Mastercard or Visa card. Data transmission and payment validation are carried out through the official collection agency PayPal. PayPal automatically encrypts the confidential data that pass between your computer and the PayPal system. Once your order has been placed, you will automatically receive a confirmation of your transaction by email at the address indicated.

Mention in the comments of the transfer the reference of your order. Your order is validated as soon as we receive your payment. To speed up the processing of your order, you can send us a proof of transfer by e-mail.

In all cases, the goods remain the property of Surfshop 1028 Sàrl until collection of the related amount.

Delivery time

An accepted order is executed as soon as possible by Surfshop 1028 sàrl or its agents. When the order is shipped, a confirmation email is sent to you with the tracking number of your package.

Upon receipt of your order, we check the availability of the product(s) ordered. In case of unavailability, we commit ourselves within 30 days from the validation of the order either to deliver the ordered product, or to offer you a similar product at a similar price, or to refund you by bank transfer.

The date of validation of the order corresponds to :

• The date of the order in case of payment by credit card online.
• The date of receipt of the transfer in case of payment by bank transfer or CCP

In case of shortage of stock on one of the products of your order, we can ship the rest of your order with your agreement. The deadlines are automatically extended in case of delays not attributable to Surfshop 1028 Sàrl or in case of force majeure making it impossible for Surfshop 1028 Sàrl to execute all or part of the contract.

Delivery

The shipping area for all our products is currently limited to Switzerland only. For all other destinations, please contact us by email and we will find you an advantageous solution.

The delivery costs are indicated at the time of ordering. In case of delivery outside of Switzerland, the customer is responsible for paying the taxes and customs fees required by the legislation of the country where the package is received. For any parcel returned for this reason, the customer will be charged for the return costs.

If your order includes several items of different brands, your delivery may be made in several packages. Shipments are made by post or by carrier depending on the nature of the package. Please note that we need to know a delivery address where the parcel can be received during the day (e.g. workplace, etc.), as well as your telephone number during the day.

You must check the condition and conformity of the goods delivered at the time of delivery and before signing the carrier's delivery note. You must indicate on the delivery note and in the form of handwritten reservations accompanied by your signature any anomaly concerning the delivery (damaged product). This verification is considered to have been carried out as soon as the buyer, or a person authorised by him, has signed the delivery note. You must also report any anomalies by registered mail and confirm your reservations to the carrier at the latest within 3 working days of receiving the item(s). Please send a copy of this letter to on-line@surfshop.ch. Goods delivered in error or in excess must be returned immediately, or at the latest within 7 days. If the goods are not returned, they will be invoiced.

Warranty

The buyer benefits from the legal guarantee of hidden defects of the products he/she has purchased. The warranty period is that granted by the manufacturers from the date of the invoice, which we ask you to keep carefully. The warranty from which the buyer benefits after the purchase of the product is personal and non-transferable. Second-hand products are normally sold without warranty.

Return

In case of error, defect or non-conformity of the products, the buyer has 7 days after receipt of the goods to return the ordered products to Surf Shop 1028 Sàrl for exchange or refund without penalty, except for shipping costs.

All return requests must be made by email to on-line@surfshop.ch. Packages returned without a valid return number will be refused. Returned products must be complete, in their original condition, accompanied by their accessories and a copy of the invoice to which the return number will be attached.

The return costs are at the expense of the buyer, who must return the products in the shipping packaging of Surfshop 1028 Sàrl or its agents. In case of non-compliance with the above provisions, a processing fee will be charged and debited from the amount due to the buyer.

Litigation

In case of dispute, the purchaser will address in priority to Surfshop 1028 Sàrl which will endeavour to find with him a solution acceptable for all the parts. This contract is subject to Swiss law. For all other cases not governed by the present conditions of sale, the Swiss Code of Obligations applies. The exclusive place of jurisdiction is Morges (Switzerland).

Surfshop 1028 Sàrl cannot be held responsible for damages of any kind, material or immaterial, which could result from a bad functioning or misuse of the marketed products. It is the same for the possible modifications of the products resulting from the manufacturers. The responsibility of Surfshop 1028 Sàrl, in any case, limited to the amount of the order. The choice and the purchase of a product or a service are placed under the only responsibility of the customer. The total or partial impossibility to use the products in particular because of incompatibility of the material cannot give place to any compensation, refunding or questioning of the responsibility of Surfshop 1028 Sàrl, except in the case of a proven hidden defect, nonconformity or defectiveness.

Data protection

The personal information collected in the context of distance selling is mandatory, as this information is necessary for the processing and delivery of orders and for the establishment of invoices. Surfshop 1028 Sàrl is committed to respecting the provisions of the federal law on data protection. All personal data transmitted by the customer are treated confidentially and will not be given to third parties under any circumstances. The customer has the possibility to modify his personal data at any time.
